A powerful group is openly continuing construction work in Chhatak, Sunamganj, in violation of the Section 144 ban imposed by the court. Despite receiving a notice of the court’s ban, they have continued the construction work. Due to this, one party is being deprived of justice. The incident took place in Gargaon village of Kalaruka union of the upazila.
According to local sources, about 31.5 hectares of land under JL No. 263, Khatian No. 111, Dag No. 725 of Mahmudpur Mouza of Kalaruka union of the upazila is owned by Md. Shafiq Mia, son of the late Ahmad Ali of Gargaon village, his brothers Rafiq Mia and Masuk Mia. There is a road for the transportation of 8 families of their homestead through a part of the land.
It is alleged that an influential group led by Arifur Rahman and Hasanur Rahman (Pushpa), sons of Ashikur Rahman of the same village, has been creating obstacles on the road for a long time in order to occupy the land. On September 16, Md. Shafiqul Islam filed a miscellaneous case No. 658/25 in the Sunamganj District Magistrate Court as the plaintiff. After the hearing, the court issued a ban on the memorandum No. 1894 under Section 144 of the Code of Criminal Procedure on that day. On September 17, Chhatak Police Station SI Mohiuddin served a notice of the ban on both parties by the court.
However, it has been alleged that despite the police issuing a notice, the opponents have been building gates and walls on the road for the last 3 days, disobeying the court order. In addition, the victims have alleged that 2 harassment cases including extortion have been filed against them to weaken the opponents due to a land dispute. They said that the influential people are continuing the construction work by abusing their power in violation of the court’s ban. They are not getting any redress after filing a complaint with the police station. They even tried to file a complaint with the police station on September 18 but failed.
On the spot, it was seen that the construction work of the gate and wall is ongoing on the road. Although the opponent claims that they are working on land of 721-722 dag. But the victims claim that there is no mention of land dag or damage in any documents related to this or in the complaint filed by them.
Accepting the truth of the incident, Chhatak Police Station SI Mohiuddin said that after both sides were given a ban notice by the court, they received information that the work is going on. He has informed the OC about the matter.
Police Station OC Shafiqul Islam Khan said that if there is evidence of disobeying the court’s order, legal action will be taken against them after an investigation.
